Navigating the U.S. immigration system often involves a great deal of paperwork, and receiving official notices can be a source of both relief and confusion. If you have recently received Form I-391, Notice of Immigration Bond Cancellation, it is generally good news. At Smith Knudson, we are dedicated to providing clear, compassionate guidance to help you understand every step of your immigration journey. This notice signifies that the financial obligation tied to an immigration bond has ended.

Essentially, Form I-391 is the government’s official confirmation that an immigration bond has been canceled. This typically happens when the immigration case has concluded because the individual has:

  • Been granted lawful status.
  • Complied with an order of voluntary departure.
  • Been removed from the United States.

Once ICE determines that the terms of the bond have been met, it issues this form to the person who posted the bond (the obligor), officially closing the contract.

Common Issues: Missing or Delayed Forms

While the process is supposed to be straightforward, delays can happen. If you believe the immigration case has concluded but you have not received Form I-391, it is important to be proactive. The first step is to confirm the case is officially closed with the immigration court. Sometimes, administrative backlogs at ICE can delay the issuance of the cancellation notice. If a significant amount of time has passed, you may need to follow up with the ICE ERO office that had jurisdiction over the case. Keeping detailed records of your communications is crucial.

Form I-391 vs. Form I-305: What’s the Difference?

It is easy to confuse the different forms involved in the bond process. Think of them as the bookends of your financial agreement with the government.

  • Form I-305, Receipt of Immigration Bond: You receive this form when you pay the bond. It is your original receipt and proof of payment. You must keep this document in a safe place.
  • Form I-391, Notice of Immigration Bond Cancellation: You receive this form when the case is over, and the bond is canceled. It is the key to getting your money back.

In short, Form I-305 starts the clock, and Form I-391 stops it.

How to Request Your Bond Refund

Receiving Form I-391 is the most important step toward getting your bond money refunded. To process the refund, the obligor must mail the original Form I-305 receipt along with the Form I-391 notice to the Debt Management Center in Vermont. It is highly recommended to send these documents via certified mail to have a tracking record. Once the center processes your request, a refund check will be mailed to the address on file. If you have moved, ensure you have updated your address with ICE to avoid further delays.

The Importance of Recordkeeping

Even after the bond is canceled and the refund is received, we advise our clients to keep copies of all bond-related paperwork. This includes your Form I-305, Form I-391, and any correspondence with ICE or the immigration court. These documents serve as a complete record of your compliance and the closure of your financial obligations, which can be useful for any future reference.
