Colorado Citizenship & Naturalization Attorneys

Do You Have Citizenship and Naturalization Questions?

Many non-citizens living in the United States want to become citizens, and this has many benefits. When we think of what it means to be a citizen, the first thing that comes to mind may be that citizens can vote in the United States or that individuals are citizens if they are born in the United States.

One major benefit is that citizenship is almost impossible to lose once you have it. It provides a new level of security that the U.S. is your home and a new level of freedom because you can travel without the many restrictions that nonresidents must consider. However, citizenship is not the best strategy for every client and the application can lead to serious consequences. Smith Knudson will thoroughly assess each case for risks and advise each client based on our extensive experience.

While the citizenship process can be long and tenuous, it is made easier with the help of our attorneys.

Understanding Naturalization

Naturalization is the way lawful permanent residents become U.S. citizens. Lawful permanent residents generally may naturalize on their third anniversary of gaining residency if they gained residency through marriage to a U.S. citizen or on their fifth anniversary if it was acquired by other means. The timeline may be shorter if you are in the military.

Requirements for Obtaining U.S. Citizenship

There are requirements for naturalization, including:

  • Be at least 18 years old at the time of application
  • Have been a legal permanent resident (LPR) for the past 3 or 5 years, depending on how you obtained your LPR status
  • Have continuous residence in the U.S.
  • Have the ability to read, write and speak basic English (unless over 50 years old and lived in the U.S. for at least 20 years, or over 55 and 15 years of living in the U.S.)
  • Demonstrate good moral character
  • Be able to demonstrate a basic knowledge of U.S. history and government
  • Demonstrate a loyalty to the principles of the U.S. Constitution

The final step in naturalization is pledging allegiance to the U.S. in a formal ceremony.

Exploring All Paths to Citizenship

Some people are U.S. citizens and don’t even know it. Citizenship can be acquired in various ways, not just through birth in the U.S. Individuals with family history in the United States or Native American roots should explore whether they may already be citizens as part of an immigration consultation. Smith Knudson helps individuals explore their family histories and apply for benefits as U.S. citizens when such a case arises.
