Know Your Rights

IF YOU ARE ASKED ABOUT YOUR IMMIGRATION STATUS

• Do not answer any questions. Just say “I need to speak to my lawyer” and if you don’t speak English well, say “I need an interpreter.”
• Say nothing about where you were born or how you entered the United States.
• If you carry documents or identification from another country, they can be used against you.

IF ICE IS AT YOUR DOOR

• You have the right to see a search warrant if ICE or another officer attempts to enter your home.
• Ask them to pass the search order under your door, without opening it, so as not to let them know that you are giving consent to enter or your house.
• If the officer has a search warrant, see if he is searching in an area that is not included in the warrant. Ask for a receipt for any property they take.

IF YOU ARE INTERROGATED BY THE POLICE OR ICE

• You have the right to ask the officer if you are being arrested or detained.
• If the officer says you are not being arrested or detained, ask the officer if you can leave. If the officer says you can go, go slowly.
• If the officer says you are going to be arrested or detained, YOU HAVE THE RIGHT TO REMAIN SILENT. If you are asked to identify yourself, give only your real name and your date of birth, other than that you have the right to remain silent.

IF YOU ARE ARRESTED

• Find out who arrested you. Write the names of the officers, their agencies, and their identification numbers and badges.
• Do not sign any document without first speaking to an attorney. You ALWAYS have the right to speak to an attorney. Don’t be fooled by bullying tactics, or threats used by officials to sign documents!

THE RIGHT TO REMAIN SILENT

• Remember, never lie to an officer or give them false documents or information!
• If you are detained, say or show this to the officer then keep silent:

To Whom It May Concern:

I am choosing to exercise my right to remain silent and the right to refuse to answer your questions based on my 5th Amendment rights. If I am detained or arrested, I request to contact my attorney immediately. I am also exercising my right to refuse to sign anything until I consult with my attorney.

Under the 4th Amendment, I do not give you permission to enter my home unless you have a court-ordered warrant to enter, signed by a judge. I do not give you permission to search my belongings.
