The Department of Homeland Security (DHS) recently published the Federal Register Notice outlining the process for applying for initial TPS for Haitians and extending TPS status for current holders. DHS previously announced this extension and redesignation for TPS for Haitians on December 5, 2022.
As long as they are still eligible, Haitians who already hold TPS status will now be allowed to apply for an extension of status for an additional 18 months beginning on February 4, 2023, and ending August 3, 2024. To maintain status, Haitian TPS holders must re-register during the published 60-day re-registration period. This period runs from January 26, 2023 through March 27, 2023.
Haitians with approved employment authorization documents (EADs) based on TPS – categories (a)(9) or (c)(12) – are automatically extended through February 3, 2024. However, to receive a new EAD card valid through August 3, 2024, the TPS holder must re-register.
If initial TPS or EAD applications are still pending as of January 26, 2023, there is no need to file a new application. If USCIS approves your applications, they will be approved through August 3, 2024.
Haitians who do not currently have TPS, have been continuously residing in the United States since November 6, 2022, and have been continuously physically present in the United States since February 4, 2023, will now be allowed to apply for TPS. Haitians looking to register for TPS for the first time must do so during the initial registration period. This period runs from January 26, 2023 through August 3, 2024.
