Our mission is to provide the compassionate legal guidance necessary to bring your family back together. As your partners in this journey, we are committed to providing clear, honest advice and robust representation.

What is Family-Based Immigration?

Family-based immigration is the primary method for foreign nationals to permanently immigrate to the United States. It allows U.S. citizens and Lawful Permanent Residents (Green Card holders) to petition for certain relatives to obtain their own lawful permanent residence. The goal of this system is family unification.

While the concept is straightforward, the laws governing who can apply and when can be intricate. Having a knowledgeable attorney ensures that you understand your specific pathway and that your application is built on a solid legal foundation.

How Can I Sponsor a Family Member?

The sponsorship process typically begins with the U.S. citizen or permanent resident (the petitioner) filing a petition on behalf of their foreign relative (the beneficiary). This is generally done using Form I-130, Petition for Alien Relative.

The process generally follows these steps:

  • Filing the Petition: We help you prove the validity of your family relationship through documentation like birth certificates, marriage licenses, and financial records.
  • Waiting for Approval: USCIS reviews the petition. Processing times vary depending on the relationship category.
  • Application for Residency: Once the petition is approved and a visa number is available, your relative can apply for a Green Card. This happens either through Consular Processing (if they are abroad) or Adjustment of Status (if they are already lawfully in the U.S.).

Who Is Eligible for Sponsorship?

Eligibility depends on the status of the sponsor.

U.S. Citizens can petition for:

  • Spouses and unmarried children under 21 (Immediate Relatives).
  • Parents (if the sponsor is 21 or older).
  • Married children and children over 21.
  • Siblings (if the sponsor is 21 or older).

Lawful Permanent Residents (Green Card Holders) can petition for:

  • Spouses.
  • Unmarried children.

Please note that “Immediate Relatives” of U.S. citizens generally have visas available immediately. Other categories, known as “Family Preference,” often face annual caps and longer waiting periods.

What Challenges Might We Face?

The path to residency is rarely a straight line. Common hurdles include:

  • Long Wait Times: Preference categories can have backlogs lasting years.
  • Documentation Errors: Simple mistakes on forms can lead to rejections or delays.
  • Inadmissibility Issues: Past immigration violations or criminal records can complicate a case, often requiring special waivers.

At Smith Knudson, we proactively identify these potential roadblocks. We review your family’s unique history to determine the best strategy, ensuring that when you file, you do so with confidence.
