On January 20th, 2021, President Biden issued a memorandum to the Secretary of Homeland Security, directing them to “preserve and fortify” the DACA program.

This is a huge step forward from the previous administration, which was actively trying to get rid of the DACA program and had eliminated the possibility of doing a first-time DACA application. Thus, President Biden’s memorandum restores the program to what it was before, and that means that USCIS must accept initial applications for DACA once again.

Many people who could not file for DACA under the previous administration are now eligible for the program.
