As of August 13, 2026, leaving the U.S. with Advance Parole may trigger a 10-year bar or other serious consequences. Individuals who leave the U.S. may not be allowed to return, or may become ineligible for immigration benefits like permanent residence or other lawful status.
A new case released by the Board of Immigration Appeals, Matter of Delacarmen-Lara, 29 I&N Dec. 830 (BIA 2026), claims to overrule prior legal precedent that made using Advance Parole much less risky.
If you have Advance Parole, do NOT leave the United States without speaking with an attorney about the potential consequences first. In a large number of cases, travel on Advance Parole will no longer be advisable and may have serious consequences, including not being allowed re-entry into the U.S.
